Our services

  • 1.1. Acceptance of Terms By registering for an account, submitting your resume, participating in a video interview, or otherwise using our Services, you affirm that you are at least 18 years of age and are otherwise fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms.

  • 1.2. User Accounts and Responsibilities

    • Account Creation: To access certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
    • Account Security: You are responsible for safeguarding your account password and for any activities or actions under your account, whether or not you have authorized such activities or actions. You agree to notify us immediately of any unauthorized use of your account.
  • 1.3. Consent for Resume Submission and Video Interviews Our Services allow you to submit your resume and other application materials, and to participate in video interviews for prospective employment opportunities.

    • Resume Submission: By uploading your resume and any other personal information, you expressly consent to the storage and processing of this information by JivaHire. You further consent to the sharing of your resume and submitted information with employers who use our Services to find potential candidates for job openings.
    • Video Interviews:
      • Consent to Record: Prior to participating in any video interview, you will be explicitly asked for your consent to be recorded (audio and video). If you do not consent, you will not be able to participate in the video interview through our platform.
      • Use of Recordings: By consenting, you agree that JivaHire and the prospective employer for whom the interview is being conducted may record, store, review, and share the video interview recording as part of the recruitment and hiring process. This may include sharing the recording with individuals involved in the hiring decision-making process at the employer’s organization.
      • Data Ownership: You retain ownership of your likeness and voice, but you grant JivaHire and the relevant employer a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display your video interview recording solely for the purpose of the recruitment process for the specific job application or for general consideration for other roles with that employer if you so consent.
  • 1.4. Platform’s Role and Responsibilities

    • JivaHire acts as a venue to connect Candidates with potential Employers.
    • We are not involved in the actual hiring decisions made by Employers.
    • We do not guarantee that you will be contacted for an interview or offered a job.
    • We are not responsible for the job descriptions, requirements, or hiring practices of Employers using the platform.
    • We reserve the right to remove any content or suspend or terminate accounts that violate these Terms.
  • 1.5. Data Privacy and Protection Your privacy is important to us. Our collection, use, storage, and disclosure of your personal information (including resumes and video interviews) are governed by our [Link to Privacy Policy]. Please review our Privacy Policy carefully to understand our practices.

    • Information Collection: We collect information you provide directly to us, such as when you create an account, upload your resume, or participate in a video interview. We also collect certain information automatically when you use our Services.
    • Use of Information: We use your information to provide and improve our Services, connect you with potential employers, facilitate the interview process, and communicate with you.
    • Data Sharing: As described in Section 1.3 and our Privacy Policy, your resume and video interviews will be shared with employers to whom you apply or who identify you as a potential candidate. We do not sell your personal data to third parties for their marketing purposes without your explicit consent.
    • Data Security: We implement reasonable technical and organizational measures to protect your personal information from unauthorized access, use, alteration, or disclosure. However, no internet-based service can be 100% secure, and we cannot guarantee absolute security.
    • Data Retention: We will retain your personal information for as long as your account is active or as needed to provide you with Services, comply with our legal obligations, resolve disputes, and enforce our agreements. You may have the right to request deletion of your data as outlined in our Privacy Policy.

Property rights

  • 2.1. JivaHire’s Intellectual Property The Services and all their original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of JivaHire and its licensors. The Services are protected by copyright, trademark, and other laws of [Jurisdiction of Your Company] and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of JivaHire.

  • 2.2. User-Generated Content You retain all ownership rights to the content you submit to the Services, including your resume and video interviews (“User Content”). However, by submitting User Content, you grant JivaHire a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Services and JivaHire’s (and its successors’ and affiliates’) business, including for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels, solely for the purpose of providing and improving the Services and facilitating your job applications. This license is necessary for us to operate the platform and for employers to view your materials.

Prohibited Activities and User Conduct

  • 3.1. User Conduct You agree not to use the Services for any unlawful purpose or in any way that interrupts, damages, impairs, or renders the Services less efficient. You agree not to misrepresent your identity or qualifications.

  • 3.2. Prohibited Uses of the Platform You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

    • Upload or transmit any material that is defamatory, offensive, or otherwise objectionable.
    • Submit any false or misleading information, including in your resume or during video interviews.
    • Infringe upon the intellectual property rights of others.
    • Use the Services to send unsolicited messages or spam.
    • Attempt to gain unauthorized access to our systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Services.
    • Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.
    • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Platform.

Services Management

  • 4.1. Changes to Terms and Conditions We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

  • 4.2. Termination

    • We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
    • If you wish to terminate your account, you may simply discontinue using the Services or contact us to delete your account.
    • All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Other Important Legal Provisions

  • 5.1. Disclaimers THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. JivaHire EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

  • 5.2. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JivaHire, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING EMPLOYERS; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

  • 5.3. Indemnification You agree to defend, indemnify, and hold harmless JivaHire, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

  • 5.4. Severability If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

  • 5.5. Entire Agreement These Terms, together with our Privacy Policy, constitute the entire agreement between you and JivaHire regarding our Services and supersede and replace any prior agreements we might have had between us regarding the Services.
